HISTORY OF PHOENIX

Letter from CIA, March 19, 1997

Mr. Harry G. Smith

Reference: F96-1519

Dear Mr. Smith:

This is a final response to that portion of your 10 June 1996 Freedom of Information Act (FOIA) request for information pertaining to Black Eye and Group Hand. Your request was processed in accordance with the FOIA, 5 U.S.C. S 552, as amended, and the CIA Information Act, 50 U.S.C. S 431. Our processing included a search for records in existence as of and through the date of our acceptance letter dated 9 September 1996.

No records responsive to your request were located.

Although our searches were thorough and diligent, and it is highly unlikely that repeating those searches would change the result, you nevertheless have the legal right to appeal the finding of no records responsive to your request. Should you choose to do so, you may address your appeal to the CIA Information Review Committee, in my care, and you should explain the basis of your appeal.

The search fees for your request amount to $22.00 (two on-line computer searches at $11.00 each). You are entitled to the first two hours search time (equivalent to $36.00) as a requester in the "all other" fee category. Therefore, there are no charges for this particular request.

We appreciate your patience and understanding during the period required to process this request.

Sincerely,

BACK
